The son of a dentist and from a family of health care providers, Dave learned, at a young age, the value and importance of helping others. With a “just do it” attitude, Dave has, for over 40 years of his professional life, fought to protect the rights of a wide range of property owners in legal matters including construction defect litigation, insurance coverage and common interest community disputes.
Prior to law school, Dave worked in Washington DC in national politics as a legislative aid to Congressman Otis Pike assisting the congressman in his Ways and Means and Budget committee assignments. During his 2-year tenure on the Hill, Dave developed a keen understanding of the “art of making law” working at the side of Congressman Pike in devising and passing new law covering, among others, energy tax credits, prevention of Medicare/Medicaid fraud and abuse, and controlling health care costs.
His Capitol Hill experience was important in Dave’s law practice. As a member of the Nevada Citizens For Justice (CFJ) and its Board of Governors, Dave joined its legislative team to work with the Nevada legislature to enact new Nevada law designed specifically to protect the rights of homeowners to enforce construction defect claims. Known to Nevadans as “Chapter 40”, the law is recognized nationally as a tough, effective and fair scheme to protect homeowners from faulty home construction.
Over the years, the Pursiano Law approach to winning advocacy starts with direct lawyer involvement in the case development. To begin, this means listening to the client’s concerns about his/her property defects. Since experts are critical to diagnosing the defects and designing an effective repair, Dave and his partners collaborate closely with the experts to assure the expert investigation establishes the necessary factual basis to satisfy the legal “burden of proof” to win the case. In doing so, Dave and his partners can manage the expert investigation to be efficient and cost effective. The end product is a successful formula to focus the jury’s attention on the important and serious defect issues to maximize the client’s recovery.
Technology can play an important role in litigation not just in the presentation of the evidence but in formulating the evidence to be presented. Pursiano Law has trailblazed the use of “High Performance Computing” aka “Super Computers” to expose building failures using “parametric predictive analysis.”. This advanced scientific and technology driven tool, gives the Pursiano team a critical edge in predicting future building damage from known building defects. This advantage means the jury is presented a bright line and clear picture of the nature and extent of defective conditions and the necessary repair fix to correct building defects to prevent future damage.
Dave’s trial and case successes include, among others, an award of $12.5 million against the builder of a condominium project in Carlsbad, California and a $15 million judgment against a single-family home builder in Surprise Arizona. He was lead counsel in a “Class Action” lawsuit involving 137 homes in Henderson, NV resulting in a judgment and settlement of $12.725 million. He represented a group of 125 single family homeowners in North Las Vegas whose homes were damaged due to expansive and corrosive soils in a settlement of $6.8 million. Similarly, he was lead counsel in a lawsuit involving 132 homes in El Centro damaged by expansive and corrosive soils which settled for $6.75 million. Over the course of his career, Dave has tried or settled client claims totaling over $250,000,000.
